8. Fees and Payment

All fees are non-refundable except as required by law or as explicitly provided by Moss Labs.

9. Data Ownership & License

You retain all ownership rights in Your Content.
You grant Moss Labs a worldwide, royalty-free license to use, reproduce, display, and transmit Your Content as reasonably necessary to provide and operate the Service.

10. Security

Moss Labs uses commercially reasonable measures designed to protect your data. However, no security system is impenetrable, and transmission of information over the internet is at your own risk.

11. Termination

Context OS, Inc. may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with notice where required by law.

12. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory.

13. Limitation of Liability

To the maximum extent permitted by law, Context OS, Inc.'s total liability arising out of or related to these Terms or the Service will not exceed the amounts you have paid to Context OS, Inc. in the twelve (12) months prior to the event giving rise to liability.

14. Indemnification

You agree to indemnify, defend, and hold harmless Context OS, Inc. and its officers, directors, employees, and agents from and against all claims, liabilities, losses, and expenses arising from your misuse of the Service or violation of these Terms.

15. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

Informal Resolution: Before seeking arbitration or court action, you agree to attempt to resolve any dispute by contacting Context OS, Inc. at support@dtccalendar.com.
Arbitration: Except for small claims matters or where prohibited by law, you and Context OS, Inc. agree to resolve disputes through binding arbitration administered by a recognized arbitration organization, under the laws of the State of New Jersey. The arbitration shall be conducted in English. Each party shall bear its own costs and fees, and the arbitrator may award any remedy permitted by applicable law.
Class Action Waiver: You and Context OS, Inc. agree that any dispute will be resolved on an individual basis and not on a class, collective, or representative action basis.

16. Governing Law

These Terms are governed by the laws of the State of New Jersey, excluding conflict of laws principles.

17. Changes to Terms

Context OS, Inc. may update these Terms from time to time. If we make material changes, we will provide notice via the Service or email. Continued use of the Service after changes means you accept the updated Terms.
